In 2009 Florida Workers’ Compensation Rates will Fall- then Increase?

A scheduled January reduction in Florida’s workers’ compensation rates may turn out to be short-lived.

The National Council on Compensation Insurance, which sets rates for workers’ compensation insurers, is proposing an 18.6 percent rate increase just as rates were scheduled to drop by that amount, starting Jan. 1.

Why the confusing twist of events? An October ruling by the Florida Supreme Court favoring attorneys who represent injured workers. NCCI estimates that the court’s decision to end the attorney fee schedule will result in an increase in legal fees, as well as larger workers’ compensation awards.

NCCI spokeswoman Lori Lovgren said Monday that the Boca Raton-based firm wants an 8.9 percent increase in Florida workers’ compensation rates, beginning in March, and will seek a second boost sometime next year. The latter hike would go into effect in 2010, she said.

The new rates are subject to approval by Insurance Commissioner Kevin McCarty, who has set a public hearing for Dec. 16. We’ll keep you posted.
