California Workers’ Compensation Insurance Rates Could Be Reaching New Highs

A 30% increase in California workers’ compensation insurance! That’s somewhere in the ballpark says Dave Bellusci - chief actuary for the state of California workers’ compensation insurance review board.

WCIRB says the current calculation does not include a separate element for the impact of the Almaraz/Guzman and Ogilvie decisions, as it is assumed that the impact of those cases is already in the underlying data. The WCIRB is sticking to its previous story and continues to peg that impact at 5.8%.

California’s high workers’ compensation insurance rates have created a feeding frenzy for the PEO and Employee Leasing industry in the past few years. With discounts of up to 40% or more compared to California’s state fund rates, we’re seeing a huge increase in the California market - and employers are desperately searching for help.

Savings on group health care insurance premiums and reducing increased governmental compliance issues are just a few of the other advantages of a California PEO service.

PEO HR Services - A Rapidly Growing Trend

I’m reading more and more articles from around the country like the one I’ve included in this blog, regarding discrimination and Fair Labor Standards Act (FLSA) lawsuits. This growing trend along increasingly more governmental regulations (classification of independent contractors), also addressed in the article, continue to build value in utilizing PEO/Employee Leasing services.

Where employers have typically thought of accessing a PEO for reduced rates on workers’ compensation or health insurance costs, since the beginning of the year, we’ve noticed employers contacting us specifically requesting help with human resource issues. I recently commented on one of the fastest growing business insurances - Employment Practices Liability Insurance (EPLI), which relates to this article and protects against sexual harassment, age and gender discrimination, and has seen a dramatic rise as well.

A Poor Communication Story

I had a business owner call me who was angry with his PEO provider. Seems that a larger PEO purchased his PEO a little over a month ago and both parties neglected to tell their customers. When his office manager mentioned that the phones were rolling over and being answered by a different company name - he called. When he ask why hadn’t got notification of the ownership change, he was told “they were getting ready to contact everyone.”

Now this isn’t a small company, or a business who has been let go. I don’t know why, but I’ve heard these stories before from mergers and acquisitions and don’t quite understand the logic? I suppose if your theory is that people may leave you because of change, then that’s a position I don’t buy into. If you really believe in what your company has to offer though and know that you’re truly upgrading your customers benefits and services - wouldn’t you want to let them know immediately?

Workers’ Comp - Don’t Get Caught Without It!

Four Jacksonville-area construction contracting companies were caught in a sweep for violations of Florida Worker’s Compensation laws June 2 and 3, according to a release from CFO Alex Sink.

Three St. Johns County businesses, Professional Paint of JAX Inc., Interior Exterior Specialists Inc., and SER Wall Covering Corp., all were cited for failure to secure the insurance for their employees, as was Ochoa Drywall Inc., of Middleburg, according to records. Each had fewer than five uninsured employees.

Statewide, the Department of Financial Services’ Division of Workers’ Compensation Bureau of Compliance shut down 70 such companies after random site visits revealed they didn’t carry required workers’ compensation insurance, Sink announced Wednesday. Of 75 companies statewide listed as having been included in the sweep, only five were not construction or construction contracting-related.

Businesses in construction are required to carry the insurance when they employ anyone, including the owner.

Non-construction businesses are required to carry it when they employ more than four, according to the state CFO’s office. The orders are issued for violations including failure to obtain coverage, paying employees “under the table” in cash and under-reporting payroll, and misclassifying employees for a lower workers compensation rate.
