What is certified payroll?
Prevailing Wages or Prevailing Wage Rate Requirements (the compensation for a worker given for performed labor) for Federal and Federally-Assisted Construction projects are governed at the Federal level by the Davis-Bacon Act, and mandate the submission of weekly certified payroll reports.
What is the Davis-Bacon Act? A federal law that applies to contractors and subcontractors performing on federally funded or assisted contracts in excess of $2,000 for the construction, alteration, or repair (including painting and decorating) of public buildings or public works. Davis-Bacon Act contractors and subcontractors must pay their laborers - employed under the contract no less than the locally prevailing wages and fringe benefits for corresponding work on similar projects in the area. The Davis-Bacon Act directs the Department of Labor to determine such locally prevailing wage rates. The Davis-Bacon Act applies to contractors and subcontractors performing work on federal or District of Columbia contracts.
What is a Certified Payroll Report and What makes it “certified”?
A certified payroll report consists of two pages or sheets. The first sheet reports, payroll by employee for a specific job; while the second sheet, known as a Statement of Compliance, which must be signed by the payroll administrator or other company official, and contains language “certifying” that the information is correct and true. It is the signature on the Statement of Compliance that makes the payroll report “certified”.

Raleigh | Workers’ compensation insurance rates will be dropping in North Carolina next year, for the first time in five years.
The News & Observer of Raleigh reported Wednesday the North Carolina Rate Bureau has requested an average drop of 4.4 percent for 2009.
The Rate Bureau represents more than 150 companies that offer workers’ compensation insurance policies to employers in the state.
State Insurance Department spokeswoman Kristin Milam says the agency is reviewing the filing to determine if a 4.4 percent cut is enough. The department has 60 days to review the request.
Rate Bureau general manager Ray Evans says the reduction comes after several years of increases. Evans also says the cost of claims has been lower than expected and the number of workplace accidents is down.

A pending Florida Supreme Court ruling involving claimant attorneys’ fees is predicted to possibly change the workers’ compensation landscape for businesses, insurance carriers and other stakeholders.
Claimant attorneys expect the court will hand down its decision in Emma Murray V. Mariner Health/ACE USA any day. (See tampabay.bizjournals.com for updates).
Depending on the decision, these attorneys’ practices could return to volume levels before the state Legislature rewrote workers’ compensation laws in 2003 or their business could continue to languish as it has since the reforms.
If the court upholds the 2003 changes, employers will continue to enjoy low, competitive workers’ compensation insurance rates that followed the reforms, which included restrictions on claimant attorneys’ fees.

AUSTIN, Texas, Sept. 4 (UPI) — A Texas court has agreed to rehear a controversial case that could determine whether contract workers ever have the right to sue for injuries at a work site.
Also at issue in Entergy Gulf States Inc. vs. John Summers may be Texas’ unique workers compensation system, which grants immunity from lawsuits to employers but guarantees medical costs and lost wages from injury by the state to employees. Employers may opt in or out of participation.
Immunity did not extend to non-participants or employers of contract workers until a Texas Supreme Court ruling in August 2007.
Rick Levy, general counsel for the Texas AFL-CIO, said the result was that work site owners get a “double bite at the apple” under the court’s initial ruling, which allows them not to pay for the insurance but to still have immunity protection, the Austin (Texas) American-Statesman reported Thursday.
The expansion of lawsuit protection resulted in enough political and legal criticism for the court to agree to an October rehearing of the Entergy case. Both Republican and Democratic legislators had threatened to take action to restore what they saw as a threat to undermine the entire unemployment compensation system.

JEFFERSON CITY, MO – A total of 155 fatal work injuries were recorded in Missouri in 2007, down approximately 7.2 percent from the revised 167 fatal work injuries reported for 2006, according to the Census of Fatal Occupational Injuries, conducted by the Missouri Department of Labor and Industrial Relations, Research and Analysis Section in cooperation with the Bureau of Labor Statistics (BLS), U.S. Department of Labor. A total of 5,488 fatal work injuries were recorded in the United States in 2007 – a slight decrease from the revised total of 5,840 fatalities in 2006. This figure represents the smallest annual preliminary total since the Census of Fatal Occupational Injuries program was first conducted in 1992. The Census of Fatal Occupational Injuries classifies industries using the North American Industry Classification System (NAICS) and classifies occupations using the Standard Occupational Classification (SOC).
